Previous results using a standard dose and schedule of Genasense (i.e., approximately 500 mg infused over 24 hours daily for 7 days) suggested this investigational combination was associated with clinical activity and good tolerability in 18 patients.

In the new schedule, Genasense was administered with the same chemotherapy as a brief IV infusion over 1-hour twice per week for 4 consecutive weeks at a dose of 900 mg. This schedule compresses approximately 48 hours of standard dosing into a brief 1-hour infusion.

To date, 10 patients with Stage IV metastatic melanoma have been accrued to this ongoing trial. Three patients achieved confirmed partial responses after the first 2 treatment cycles with current durations lasting from 24 to 40 weeks. One patient has maintained stable disease that has lasted 16 weeks, two patients have progressed, and four patients are too early to evaluate, having received only a single cycle. Only one episode (i.e., Grade 3 neutropenia) of any Grade 3-4 adverse event has been observed.

“With a preliminary disease control rate (defined as complete or partial responses plus stable disease lasting at least 3 months) of 67%, we view these data as very promising,” said Dr. Loretta M. Itri, Genta’s President, Pharmaceutical Development. “Temozolomide is the active metabolite of dacarbazine that has been used in our Phase 3 trial in patients with advanced melanoma. I am pleased to confirm that Genta will continue the Phase 3, randomized, double-blind AGENDA trial in order to determine overall survival in that study. Sunesis Pharmaceuticals, Inc. (NASDAQ: SNSS) today reported data from two nonclinical studies of voreloxin at the AACR-EORTC-NCI Molecular Targets and Cancer Therapeutics Conference, which is being held in Boston, MA from November 15-19, 2009.

In one study, clinical proof-of-mechanism is established in samples from patients treated with voreloxin in the Company's ongoing Phase 2 clinical study of voreloxin in combination with cytarabine in relapsed or refractory acute myeloid leukemia (AML). In an additional study, voreloxin's synergistic and additive effects are demonstrated in combination with cytarabine, azacitidine, decitabine and clofarabine, agents which are currently used in the treatment of AML. Results from both of these studies support the current combination study and identify potential opportunities for further clinical evaluation.

"The data obtained from patient samples are an important addition to our clinical characterization of voreloxin's pharmacodynamic impact and further confirm our mechanistic understanding," said Judith A. Clinical Evidence of Mechanism-Based Pharmacodynamic Activity in Voreloxin-Treated AML Patients

In a poster presentation titled "Clinical Evidence of Mechanism-Based Activity in Voreloxin-Treated AML Patients" (abstract number C226), Sunesis presented nonclinical data that demonstrated mechanism-based pharmacodynamic activity of voreloxin in patients enrolled in an ongoing phase 1b/2 clinical study of voreloxin in combination with cytarabine in relapsed or refractory AML. The study identified pDNA-PKcs and pCHK2 as mechanism-based pharmacodynamic markers of response to voreloxin. These observations were consistent in cancer cell lines and in peripheral blood mononuclear cells (PBMC) of AML patient donors that were treated ex vivo with voreloxin. Furthermore, the DNA damage response to voreloxin, which was activated in PBMC from AML patients who received voreloxin at doses equal to or greater than 34 mg/m2, was differentiated from that of cytarabine.

Voreloxin is Synergistic in In Vitro Combination with Cytarabine and Additive in Combination with Azacitidine, Decitabine and Clofarabine

In a poster presentation titled "Voreloxin is Synergistic in In Vitro Combination with Cytarabine and Additive in Combination with Azacitidine, Decitabine and Clofarabine" (abstract number C222), Sunesis presented nonclinical data supporting the combination of voreloxin and cytarabine, a regimen currently used in Sunesis' Phase 1b/2 clinical study in patients with relapsed or refractory AML. Voreloxin activity in combination with other agents currently in clinical use as treatments for AML is also reported. The study showed that voreloxin, when combined with cytarabine, demonstrated synergistic activity in two AML cell lines and was additive in an ALL cell line. Voreloxin was found to be additive when combined with nucleoside analogs azacitidine, decitabine and clofarabine, suggesting that combining voreloxin with other DNA damaging agents currently in clinical use for the treatment of AML is feasible.

They might be the only businesses in Colorado begging for their products to be taxed.

But a number of medical-marijuana dispensaries say taxation is critical for their industry's long-term health, and many say they've been collecting sales taxes for months -- before a legal opinion issued Monday saying their products are taxable.

After the opinion from Attorney General John Suthers, medical-marijuana dispensaries could be facing penalties for not collecting sales taxes that could include fines and, ultimately, seizure.

Mark Couch, a spokesman for the Colorado Department of Revenue, said agency officials met Monday to discuss sending a letter to dispensaries statewide to inform them about paying the state's 2.9 percent sales tax.

"We'll be actively contacting them to remind them of their legal obligations," Couch said.

Dispensaries also must obtain state retail sales-tax licenses, which cost $4 for one year. Starting in January, businesses can purchase two-year licenses for $16.

Suthers' opinion said medical marijuana is subject to state sales tax as are food products made with it. Marijuana seed, however, is considered an agricultural product and exempt from sales tax.

For dispensary owners like Miles Zalkin, who operates Pain Management of Colorado in Denver, the opinion just means business as usual.

"We've been collecting sales tax from Day One," said Zalkin, whose business has been open just over a year. "We run our business as if it was regulated."

Zalkin estimated he's collected tens of thousands of dollars in Denver and state sales taxes.

"We are in favor of taxation," he said. "We are in favor of seeing new regulation come in and clean this industry up."

Couch said that of some 60 dispensaries in Colorado that revenue officials have identified -- and he said there may well be more -- about half are paying sales taxes.

He said the department has no way to track how much has been collected in sales taxes from dispensaries, and the agency has no estimates of how much revenue medical marijuana will generate.

California officials reported having collected about $11.4 million in tax on some $142 million of medical-marijuana sales in 2005-06.

A number of cities and counties have taken the position that sales taxes apply to medical marijuana. Boulder officials estimated the city is reaping between $2,400 and $3,000 a month from medical-marijuana sales.

City officials in Denver said the city has no estimate on how much sales-tax revenue the dispensaries will produce but is preparing to instruct dispensaries on how to collect the sales tax and remit it to the city.

Denver's sales tax is 3.62 percent.

Ernie Travis, owner of Boulder Vital Herb, said he recognized early that paying sales taxes was important "to make marijuana look legitimate to the community."

Travis added, "There's a lot of positive things marijuana can do. Taxes is just one of them."

Lawmakers likely will be asked in January to set up regulations on the industry. For Rep. Steve King, a Grand Junction Republican and a veteran police officer who used to present anti-drug programs in schools, the irony is inescapable.

Four years, six drafts and nearly 1,000 stores later, the City Council on Wednesday will consider a long-awaited, oft-debated medical marijuana ordinance whose provisions have shifted dramatically in recent days.

City Attorney Carmen Trutanich had sought to ban sales at dispensaries, but two city committees rejected the idea and suggested that cash could exchange hands as means for reimbursement but must comply with state law.

"The council is free to ignore our advice," said David Berger, a special assistant to Trutanich whose office has revised the ordinance six times. "We respect that they are the policymakers. If they decide on something different that's their prerogative."

The dispute over what is permissible under state law has led to a two-year delay on an ordinance vote while a proliferation of pot shops—officials estimate as many as 600 over the past eight months alone—have opened across Los Angeles.

Authorities believe it has led to widespread abuse of a 1996 state ballot measure allowing sick people with referrals from doctors and an identification card to smoke marijuana. State law was amended in 2003 to allow collectives to provide pot grown by members but must be not-for-profit.

In response to the possible passage of the ordinance, Los Angeles County District Attorney Steve Cooley reiterated a pledge to target pot clinics that profit and sell to people who don't qualify for medical marijuana.

Cooley said he believes state law authorizes the possession, use and cultivation of marijuana for medicinal purposes, but not the sale of the drug. Dispensary owners have argued they sell marijuana to their customers as a way to cover their costs.

"Any proposed ordinance allowing for the sales of marijuana is in direct conflict" with state law, Cooley said in a statement.

While other California cities such as San Francisco, Oakland and West Hollywood have been able to regulate medical marijuana, Los Angeles has fumbled to adopt guidelines.

In 2007, city officials approved a moratorium prohibiting new medical marijuana dispensaries. More than 180 clinics qualified to remain open, but many others took advantage of a loophole known as a "hardship exemption" that allowed them to open while awaiting city approval.

There are now as many as 1,000 marijuana dispensaries in Los Angeles alone, far more than any other city in the nation and more than the number of Starbucks and public schools in the city. There were a mere four pot outlets in 2005 when city officials first discussed a local medical marijuana law.

Fourteen states, including California, permit medical marijuana. Pot, however, remains illegal under federal law.
Last month, a judge temporarily barred city officials from enforcing the moratorium, saying the City Council failed to follow state law when it extended an initial ban.

"To some extent, they have put themselves in this situation by failing to act sooner," said Alex Kreit, an assistant professor and director of the Center for Law and Social Justice at Thomas Jefferson School of Law in San Diego. Kreit sits on a medical marijuana task force for the city of San Diego.

Medical marijuana advocates said they simply want clear regulations they can follow and Trutanich has misinterpreted state law in attempting to ban sales.

"The reason we have these problems is because the council failed to act in a timely manner," said Dege Coutee, who runs the Patient Advocacy Network. "There was a void that needed to be filled and people went in and filled it."
If the ordinance passes, the dispensaries would have to close until they comply with the new local law, Berger said. City officials would seek an injunction against those who don't. Berger added he expects council members to discuss possibly capping the number of dispensaries allowed within city limits.

Daniel Sosa, who runs two dispensaries that opened before the city's moratorium was enacted, said he's unsure what will happen to his business given the dueling messages from the council and Cooley.

"It's still very muddled," Sosa said. "I can't see how they are going to shut down the number of dispensaries out there."

Caught in the middle are residents, some of whom support medical marijuana dispensaries but are concerned the clinics have contributed to blight in their neighborhoods.

David DeLaTorre, who lives near Dodger Stadium, said he believes council members have let the problem go unchecked and they should come up with solutions soon.

"Set up a district where these businesses can operate," said DeLaTorre, 39, a father of two. "If we want dispensaries to operate, let's change the U.S. Constitution. I'm not against it, under the right handling."

Vertigo Theme Parks (VTP), the operator of the Vertigo Theme Park in Buga, Colombia, has announced that it will open a casino at the site.

The 150,000sq ft casino will be one of the first to be located within the gates of a theme park anywhere around the world, and will include high-stake, Las Vegas style gaming tables as well as slot and gaming machines.

Kevin Johnson, chief executive of VTP, said the casino will be managed by an external operator under a facility management agreement.

He said: "The casino will operate within the Free Zone territory of the park and with a special governmental decree it will enjoy advantageous taxation status, which will allow the overall operation of the Buga Theme Park to become even more profitable."

VTP, which has its head offices in Boca Raton, Florida, US, currently only operates the Buga site but plans to roll out its theme park concept across the globe.

It has plans to open seven new Vertigo-branded parks in seven years.
